Former Costa Rican president, Miguel Ángel Rodríguez, is finally getting his day in court, as preliminary hearings into the ICE-Alcatel scandal began yesterday (Monday) at 10am. Ten others are standing accused in the case with Rodríguez.

The hearing began after the Hacienda penal judge refused to suspend the hearing at the request of Rodríguez who wanted to the court to wait the resolution of the Sala IV (Constitutional Court) on his action of unconstitutionality before commencing the proceedings.

In addition, the Fiscalía (prosecutor) requested for an inclusion of evidence contained that had been omitted in the indictment. (more…)

Marriage To A Costa Rican Does Not Grant Automatic Migratory Rights, Court Rules

A decision by the Sala IV (Constitutional Court) marriage by foreigners to Costa Rican nationals does not legitimize their migratory status in the country.

The court ruled against a writ of Hebeas Corpus filed against the Dirección General de Migración y Extranjería (immigration service) by a man identified by his last names, García Cabrera.

The Court, by resolution number 2008-12223, said that family ties created by a marriage does not grant a foreigner automatic legal status.

García appealed to the court to avoid being deported, arguing that his detention by immigration officials was not legal given that he is married to a Costa Rican.

Many foreigners opt for marriage to Costa Ricans as way for many to apply for legal residency and remain in the country.

ICE Won’t Award Chinese 3G Contract

The Instituto Costarricense de Electricidad (ICE) decided not to award the contract for 1.5 million 3G cellular lines to the Chinese firm, the only bidder, however, promising that users will have the technologly available as scheduled for later 2009.

Last month, Nokia, Continez, Siemens Network Costa Rica, ZTE Corporación (Samsung) and Ericsson de Costa Rica, all bowed out and left Huawei Technologies Costa Rica, as the only bidder for the 3G contract, coming it at us$538 million dollar, more than double the estimated us$225 million ICE had budgeted.

Costa Rican president, Oscar Arias, sent a letter to the ICE board of directors urging the public institution not to award the bid to the Chinese and begin a new licitation for the urgently needed cellular lines. (more…)
